PsyStar To Actually Fight Apple With Proven Apple Slaying Lawyers

Well, well, well - colour me surprised. Instead of rolling over and taking it like everyone expected, Mac clone maker PsyStar has retained the services of a high powered law firm to fight Apple's lawsuit seeking to prevent the continued sale of PsyStar's generic Mac OS X running computers (and to force PsyStar to recall all those already sold.)

The law firm of Carr & Ferrell has sparred with Apple over intellectual property rights before - and won. The firm represented Burst.com in their patent lawsuit against both Apple and Microsoft, winning $10 and $60 million from each of those companies, respectively, for their client.

The question is, where is a small, dodgy operation like PsyStar getting the money to hire a high-powered law firm? Rich uncle?

And the second, most important question: will this case be the final test to prove once and for all if conditions set in EULAs are legally enforceable? (The EULA for Mac OS X specifically forbids its installation on non-Apple hardware.)

We'll have to wait for answers to these questions, but as of now, PsyStar may actually have a chance versus Apple's legion of lawyer drones.

I'm really excited this is going to court! My guess is the agency representing Psystar has worked an agreement with the company, etc. Probably a back end thing, or they'll counter-sue Apple for something...

In any case, it's good to see this type of question posed in court once and for all, and could change the landscape of things, in particular for Apple, but also for others out there.

This is one fight to be watching, kiddies!
